Inevitably, this rapid evolution has made regulation of the technology, which by its nature (i.e. the ability to make decisions and self-learn) carries important and sensitive ethical implications, increasingly necessary and urgent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Since April 2021, the EU has therefore been working on the so-called<strong> AI Act, a first regulatory framework on Artificial Intelligence<\/strong>, the final approval of which is expected at the end of 2023 to come into force between 2024 and 2025.<\/span><\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;What is the AI Act and Why is it Important&#8221; _builder_version=&#8221;4.23.1&#8243; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>What is the AI Act and Why is it Important<\/h2>\n<p><strong>The objective of the AI Act is to ensure that AI systems used within the European Union are fully aligned with EU rights and values<\/strong>, guaranteeing human oversight, safety, privacy, transparency, non-discrimination, and social and environmental well-being.<\/p>\n<p>AI applications are increasingly capable of real-time analysis and can &#8220;decide&#8221; which actions to take based on available data. It is precisely this ability to decide and learn that necessitates the ethical evaluations mentioned at the beginning of the article. If an AI application makes a wrong decision or one that unfairly benefits or harms a human being, who will be held accountable? This is why, with the proliferation of this technology, the EU decided to work on what will be the first AI regulation in the world.<\/p>\n<p>It&#8217;s a very complex task: the rules governing the use of technologies must protect citizens&#8217; privacy and safety without limiting the possibilities for experimenting with applications.<\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;What the AI Act Envisions&#8221; _builder_version=&#8221;4.23.1&#8243; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>What the AI Act Envisions<\/h2>\n<p>The <strong>AI Regulation establishes 4 risk levels<\/strong> according to which AI applications will be categorized, and they will be subject to different levels of monitoring accordingly.<\/p>\n<h4><span style=\"font-weight: 400;\">Unacceptable risk<\/span><\/h4>\n<p>Applications using subliminal techniques or social scoring systems employed by public authorities are strictly prohibited. Additionally, real-time remote biometric identification systems used by law enforcement in publicly accessible spaces are banned.<\/p>\n<h4><span style=\"font-weight: 400;\">High risk<\/span><\/h4>\n<p>These include applications related to transportation, education, employment, and welfare, among others. Before placing a high-risk AI system on the market or into service in the EU, companies must conduct a preliminary &#8220;conformity assessment&#8221; and meet a long list of requirements to ensure the system&#8217;s safety. As a practical measure, the regulation also mandates that the European Commission create and maintain a publicly accessible database where providers are required to supply information about their high-risk AI systems, ensuring transparency for all stakeholders.<\/p>\n<h4><span style=\"font-weight: 400;\">Limited risk<\/span><\/h4>\n<p>This refers to AI systems that meet specific transparency obligations. For example, an individual interacting with a chatbot must be informed that they are interacting with a machine so they can decide whether to proceed (or request to speak with a human).<\/p>\n<h4><span style=\"font-weight: 400;\">Minimal risk<\/span><\/h4>\n<p>These applications are already widely used and constitute the majority of AI systems we interact with today. Examples include spam filters, AI-enabled video games, and inventory management systems.<\/p>\n<p>Additionally, the AI Act establishes that primary responsibility will lie with the &#8220;providers&#8221; of AI systems; however, certain responsibilities will also be assigned to distributors, importers, users, and other third parties, impacting the entire ecosystem.<\/p>\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;AI in Italy, some data&#8221; _builder_version=&#8221;4.23.1&#8243; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>AI in Italy, some data<\/h2>\n<p>Meanwhile, AI applications in our country continue to spread: the Artificial Intelligence Observatory of the Politecnico di Milano, in its latest report (February 2023), calculated that the AI market in Italy has reached a value of 500 million euros, with a +32% increase compared to 2021. Additionally, 61% of large enterprises in Italy have already initiated an AI project, while this percentage is only 15% among SMEs. However, an increase is expected in the next 24 months.<\/p>\n<p>Regulating AI applications represents a fundamental step towards the responsible and safe use of this powerful technology, shaping a future where artificial intelligence is a reliable ally that respects human values. This contributes to creating a safer and more ethical digital environment for everyone. Inevitabilmente, questa rapida evoluzione ha reso sempre pi\u00f9 necessario e urgente una <strong>regolamentazione della tecnologia<\/strong>, che per sua natura (cio\u00e8 la capacit\u00e0 di prendere decisioni e auto-apprendere) porta con s\u00e9 implicazioni etiche importanti e delicate.<\/span><span style=\"font-weight: 400;\">Da aprile 2021 l\u2019UE sta quindi lavorando al cosiddetto <\/span><strong><i>AI Act<\/i><\/strong><span style=\"font-weight: 400;\"><strong>, un primo quadro normativo sull\u2019Artificial Intelligence<\/strong> la cui approvazione definitiva dovrebbe arrivare a fine 2023 per entrare in vigore tra il 2024 e il 2025. <\/span><\/p><p>[\/et_pb_text][et_pb_text admin_label=\"Che cos\u2019\u00e8 l\u2019AI Act e perch\u00e9 \u00e8 importante\" _builder_version=\"3.17.6\"]<\/p><h2>Che cos\u2019\u00e8 l\u2019AI Act e perch\u00e9 \u00e8 importante<\/h2><p><span style=\"font-weight: 400;\"><strong>L\u2019obiettivo dell\u2019AI Act \u00e8 assicurare che i sistemi AI utilizzati all\u2019interno dell\u2019Unione Europea siano completamente in linea con i diritti e i valori dell'UE<\/strong>, garandendo il controllo umano, la sicurezza, la privacy, la trasparenza, la non discriminazione e il benessere sociale e ambientale.<\/span><\/p><p><span style=\"font-weight: 400;\">Le applicazioni AI, infatti, stanno raggiungendo capacit\u00e0 di analisi real-time sempre maggiori e possono \u201cdecidere\u201d quali azioni intraprendere sulla base dei dati a disposizione. \u00c8 proprio questa capacit\u00e0 di decidere e apprendere che rende necessarie le valutazioni etiche a cui abbiamo accennato a inizio articolo.<strong> Se un\u2019applicazione AI prende una decisione sbagliata o che privilegia ingiustamente o danneggia un essere umano, di chi sar\u00e0 la responsabilit\u00e0?<\/strong> Ecco perch\u00e9, con il diffondersi di questa tecnologia, l\u2019UE ha deciso di lavorare a quello che sar\u00e0 il primo regolamento sull\u2019AI al mondo.<\/span><\/p><p><span style=\"font-weight: 400;\">Un compito molto complesso: le norme che regolano l\u2019uso delle tecnologie devono proteggere la privacy e l\u2019incolumit\u00e0 dei cittadini, senza per\u00f2 limitare le possibilit\u00e0 di sperimentazione delle applicazioni.<\/span><\/p><p>[\/et_pb_text][et_pb_text admin_label=\"Cosa prevede l\u2019AI Act\" _builder_version=\"3.17.6\"]<\/p><h2>Cosa prevede l\u2019AI Act<\/h2><p><span style=\"font-weight: 400;\"><strong>Il Regolamento sull'IA stabilisce 4 livelli di rischio<\/strong> secondo cui categorizzare le applicazioni AI, che dovranno di conseguenza essere sottoposte a livelli diversi di monitoraggio.<\/span><\/p><h4><i><span style=\"font-weight: 400;\">Rischio inaccettabile<\/span><\/i><\/h4><p><span style=\"font-weight: 400;\">Sono strettamente vietate le applicazioni che utilizzano tecniche subliminali o sistemi di punteggio sociale utilizzati dalle autorit\u00e0 pubbliche. Sono inoltre vietati i sistemi di identificazione biometrica remota in tempo reale utilizzati dalle forze dell'ordine in spazi pubblicamente accessibili.<\/span><\/p><h4><i><span style=\"font-weight: 400;\">Rischio alto<\/span><\/i><\/h4><p><span style=\"font-weight: 400;\">Queste includono applicazioni legate ai trasporti, all'istruzione, all'impiego e al welfare, tra le altre. Prima di mettere sul mercato o in servizio nell'UE un sistema di IA ad alto rischio, le aziende devono condurre una \"valutazione di conformit\u00e0\" preliminare e soddisfare un lungo elenco di requisiti per garantire la sicurezza del sistema. Come misura pragmatica, il regolamento prevede anche che la Commissione europea crei e mantenga un database di accesso pubblico in cui i fornitori saranno obbligati a fornire informazioni sui loro sistemi di IA ad alto rischio, garantendo trasparenza per tutte le parti interessate.<\/span><\/p><h4><i><span style=\"font-weight: 400;\">Rischio limitato<\/span><\/i><\/h4><p><span style=\"font-weight: 400;\">Si riferiscono a sistemi di IA che soddisfano specifici obblighi di trasparenza. Ad esempio, un individuo che interagisce con un chatbot deve essere informato che sta interagendo con una macchina in modo da poter decidere se procedere (o richiedere di parlare con un essere umano).<\/span><\/p><h4><i><span style=\"font-weight: 400;\">Rischio minimo<\/span><\/i><\/h4><p><span style=\"font-weight: 400;\">Queste applicazioni sono gi\u00e0 ampiamente diffuse e costituiscono la maggior parte dei sistemi di IA con cui interagiamo oggi.
