E-signature systems are especially useful for remote-signing on contracts and agreements. Below are the rules governing how e-signatures can be binding outside the EU.<\/p>\n<\/blockquote>\n

\u201cIf I sign on a computer, is the contract still valid?\u201d<\/strong>
The use of digital contracts is gaining in popularity worldwide. More and more users are having to use electronic- and digital-signature systems.<\/strong> Technology, at least in Italy*, tends to viewed with a certain amount of scepticism. When someone accustomed to \u201cink\u201d signatures has to place a digital signature for the first time, this question is likely to arise. Concerns about the validity of digital signatures, especially in this increasingly international and globalised economy, compound the general worries of those routinely executing contracts and agreements with far-away countries.<\/p>\n

European law and the situation in Great Britain<\/h3>\n

In terms of the EU, the validity of the electronic signatures is established by eIDAS, Electronic Identification and Trust Services Regulation, also known as \u201cEU eIDAS Regulation no. 910\/2014\u201d. The eIDAS Regulation, which took effect in September 2014, became mandatory across EU Member States in 2018. The impetus for the law was to create a single digital market. In terms of the validity of electronic signatures in other European countries, therefore, one can rest assured of their security.<\/strong><\/p>\n

What about the UK?<\/strong> As of the passing of Brexit, the United Kingdom is no longer a member of the EU; therefore, it is not subject to the eIDAS rules. That said, before its definitive exit from Europe, the UK did pass a regulation which nearly mirrors eIDAS. Following Brexit, electronic signatures issued in accordance with eIDAS rules continue to be accepted and binding in the UK.<\/strong><\/p>\n

Electronic signatures outside the EU<\/h3>\n

The world certainly doesn’t start and end with Europe. Are electronic signatures considered binding internationally? That is, after all, where the remote-signing option would be most useful.
The answer is somewhat obvious: every country outside the EU has its own rules and regulations.<\/strong> The number of countries passing laws permitting electronic signatures grows every year. The recommendation<\/strong>, therefore, is to find out the rules applicable in the country where the transaction is going to take place, and then bolster the validity of the signatures using a local Certification Authorities<\/strong>.<\/p>\n

Qual \u00e8 la validit\u00e0 della firma elettronica fuori dall\u2019Italia?<\/h2>

I sistemi di firma elettronica sono utili soprattutto quando si stipulano contratti e accordi a distanza. Ecco quali sono le norme che regolano la validit\u00e0 della firma elettronica fuori dalla UE.<\/p><\/blockquote>

\u201cMa se metto la firma dal computer, il contratto \u00e8 valido comunque?\u201d<\/strong>.
L\u2019esigenza di digitalizzare la contrattualistica si sta diffondendo in modo sempre pi\u00f9 capillare, e per questo sempre pi\u00f9 utenti si confrontano con sistemi di firma elettronica e digitale<\/strong>. E poich\u00e9 la tecnologia, almeno in Italia*, viene guardata ancora con diffidenza, chi si trova ad usare una procedura di firma digitale per la prima volta ed \u00e8 sempre stato abituato a firmare \u201cdi proprio pugno\u201d, quasi sicuramente si \u00e8 posto almeno una volta questa domanda.<\/p>

\"\"<\/p>

Lasciando a questo articolo<\/a> l\u2019approfondimento della normativa italiana che regola le varie tipologie di firma (digitale, elettronica semplice, avanzata o qualificata), i dubbi sulla validit\u00e0 della firma digitale si possono allargare a quelli di chi regolarmente stipula contratti e accordi con i paesi lontani, in un un\u2019economia sempre pi\u00f9 internazionale e globalizzata.<\/p>

La normativa europea e il caso della Gran Bretagna<\/h3>

Per quanto riguarda i paesi appartenenti all\u2019Unione Europea, la validit\u00e0 delle firme elettroniche a livello comunitario \u00e8 regolata da eIDAS, Electronic Identification and Trust Services Regulation, conosciuto anche come \u201cRegolamento (UE) eIDAS N. 910\/2014. Il regolamento eIDAS, entrato in vigore a settembre 2014, si applica obbligatoriamente a tutti gli stati membri dell'UE dal 2018, ed \u00e8 nato proprio con l\u2019intento di creare un mercato digitale unico. Sulla validit\u00e0 delle firme elettroniche in altri paesi europei, quindi, sicurezza totale.<\/strong><\/p>

E il Regno Unito?<\/strong> Con l\u2019ufficializzazione della Brexit, il Regno Unito non \u00e8 pi\u00f9 uno stato membro dell'UE, e per questo non \u00e8 sottoposto alla normativa eIDAS. La terra dei lord tuttavia, prima di lasciare definitivamente l\u2019Europa, si \u00e8 dotata di un regolamento molto vicino a quello eIDAS: anche dopo la Brexit le firme elettroniche emesse secondo il regolamento eIDAS vengono accettate e sono valide nel Regno Unito.<\/strong><\/p>

La firma elettronica fuori dalla CE<\/h3>

Ma il mondo non finisce con l\u2019Europa, anzi. Come viene percepita la validit\u00e0 della firma elettronica a livello internazionale, dove la possibilit\u00e0 di siglare contratti e accordi a distanza trova la sua massima utilit\u00e0?
La risposta \u00e8 quasi ovvia: ogni nazione al di fuori della CE ha regolamenti a se stanti<\/strong>, e il numero di paesi che si dota di una regolamentazione per la firma elettronica cresce di anno in anno. Il consiglio<\/strong>, dunque, \u00e8 quello di tenere presente la normativa del paese con cui si va ad operare ed eventualmente integrare la validit\u00e0 della firma con delle Certification Authorities locali<\/strong>.<\/p>
